Terms & Conditions of Hire

1. Definitions

Customer – Is the person making the booking with the Company

Company – Is Stamford Wedding Cars, who provide the services under the Hire Agreement

Price – is the total sum payable by the Customer to the Company for the completion of the Hire Agreement

Booking Confirmation – Is the process of the parties entering into a Hire Agreement

Hire Agreement – Is the confirmation of the price, Car(s), date, times and venue(s) for the Hire Agreement that has been agreed between the Customer and the Company, and is a binding agreement between the parties

Hire Date – The date on which the Hire Agreement takes place, as detailed within the Hire Agreement 

Car(s) – Is any vehicle provided by the Company under the Hire Agreement 

Venue(s) – Is the location(s) for the Hire Agreement, including collection and drop-off address(es)

 

2. Price and Payment

The Price will be agreed between the parties and confirmed in writing in the Hire Agreement that we send to you. To secure the Hire Agreement, the deposit is payable at the point of Booking Confirmation.

 

Unless agreed otherwise, payment terms are a deposit payment of £100.00 per Car hired, with the balance due no later than fourteen calendar days prior to the Hire Date of your booking.

 

Once the Customer has confirmed the Hire Agreement with the Company by making the deposit payment, this is binding, and the deposit is non-refundable.

 

3. Providing the Services

Once full payment has been made, the Company shall provide the services detailed in the Hire Agreement of the Customer’s chosen Car(s) and driver(s) on the date, times and venue(s).

 

4. Problems with the Services and Your Legal Rights

Whilst the fleet of Cars are well maintained, they can and do break-down, and staff can fall ill. Should an issue arise that means that the chosen Car(s) and/or driver(s) are unavailable for the Hire Date, the Company shall offer a suitable alternative where possible. However, the Company cannot guarantee an identical alternative Car to the one that was booked under the Hire Agreement. By confirming the booking and making the deposit payment, the Customer acknowledges and accepts that an alternative vehicle may be provided in such circumstances.

 

If for any reason the Company are unable to find the Customer an alternative Car(s) and/or driver(s), the Company will use reasonable endeavours to help the Customer find alternative transport with another company.

 

If before the Hire Date, it becomes apparent for any reason that the Company are unable to commence and fulfil the Hire Agreement due to issues with Car(s) and/or driver(s), or for any other reason caused by the Company, the Company shall issue a full refund, including return of the Customer’s deposit payment.

 

If for any reason the Company commence but are unable to complete the Hire Agreement on the Hire Date, due to issues with Car(s) and/or driver(s), or for any other reason caused by the Company, the Company shall offer a partial refund of the Hire Agreement Price. The refund will be calculated on a pro-rata basis, proportionate to the portion of the Hire Agreement that was not completed. By way of example, if the Company completed half of the agreed service, a refund of 50% of the Hire Agreement Price will be due to the Customer. The Company shall notify the Customer of the proposed refund amount within 14 calendar days of the Hire Date.

 

The above does not affect your legal or statutory rights.

 

5. Events Outside of Our Control (Force Majeure)

Should the Hire Agreement commence on the Hire Date but not be completed due to events entirely outside of the Company’s control (such as severe inclement weather, road closures that prevent continuation of the journey, or other Force Majeure events), a 50% refund of the Hire Agreement Price will be payable to the Customer. For the avoidance of doubt, minor delays caused by traffic, weather, or other incidental factors that do not prevent completion of the Hire Agreement shall not give rise to a refund under this clause.

 

Should a Force Majeure event occur prior to the Hire Date, which prevents commencement and completion of the Hire Agreement, a full refund of the Hire Agreement Price will be due to the Customer, including the deposit payment. 

 

6. Cancellation

The Customer has the right to cancel the booking at any time. However, the deposit payment is non-refundable in all circumstances. In addition, the following cancellation charges apply to the balance of the Hire Agreement Price (excluding the deposit): where cancellation is made more than two calendar months before the Hire Date, no further charge will be due beyond the deposit; where cancellation is made between one and two calendar months before the Hire Date, 50% of the outstanding balance will become due for payment; where cancellation is made less than one calendar month before the Hire Date, the full outstanding balance will become due for payment. If full payment has already been made at the time of cancellation, any refund due will be calculated and returned to the Customer within 14 calendar days.

 

Should the Customer wish to cancel the Hire Agreement on the Hire Date, due to events outside of their control with other service providers, such as wedding caterers, venues or other wedding related services, no refund will be given and this will not be treated as a Force Majeure event. (Refer section 5.)

 

7. Complaints and Feedback

We take our relationship with you very seriously and aim to provide you with top-quality service. 8. How We Use Your Personal Information (Data Protection)

Your personal information is gathered solely to enable us to complete your Hire Agreement and to communicate with you in connection with it. We shall not pass on your personal information to any third party without your expressed permission, except in the following circumstances: where required to do so by law; where your contact details are shared with the driver assigned to your booking, in the event that the driver is not a direct employee of the Company, for the purpose of fulfilling the Hire Agreement; and where enquiry or booking data is processed by Wix (the platform through which our website operates), acting as a third-party data processor on our behalf. Wix processes data in accordance with their own privacy policy, which can be found at www.wix.com/about/privacy. We shall not use your personal information to send you marketing information unless you have expressly opted in to receive such communications from us. We retain your personal information for a period of up to six years following the Hire Date, after which it will be securely deleted. You have the right to request access to the personal information we hold about you, to request its correction or deletion, and to object to its processing, at any time by contacting us using the details in section 9. We process your data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

10. ​Governing Law and Jurisdiction

The law applicable to this Hire Agreement and any non-contractual obligations arising from or in connection with it, shall be governed, construed and interpreted in accordance with the laws of England and Wales.
